Customer Account Registration: An account can be created at any time and by anyone to place orders, for easy login, store shipping addresses, to maintain wish-lists for family and friends, to check the status of orders placed and to verify and track orders. When you register for an account you are requested to provide a password and your personal information. Your financial information cannot and will not be stored in your account. You are responsible for maintaining the confidentiality of your login ID and password and are responsible for all activities that your account can incur.
Checkout Without An Account: Checkout without an account is offered to anyone wanting to order from Manuela Valenti and not wanting to register and maintain an account.
Flagged Customer Accounts: A customer account can get flagged
or banned for any of the following reasons:

Valenti VIP Membership Program is a worldwide loyalty membership program. Benefits include but are not limited to:

Manuela Valenti reserves the right (but not the obligation) to remove or edit such content. If you do post content or submit material, and unless we indicate otherwise, you grant Manuela Valenti a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Manuela Valenti and sublicensees the right to use the name that you submit in connection with such content, if they choose to do so. You represent and warrant that you own or otherwise control all of the rights to the content that you post, that the content is accurate, that use of the content you supply does not violate this policy and will not cause injury to any person or entity, and that you will indemnify Manuela Valenti for all claims resulting from content you supply. Payment:
All sales throughout this website are made in US$.
Pay by Credit Card: US and International Customers have the choice of paying with Visa, Master Card, American Express and Discover through our merchant account. To pay with your credit card simply enter your information in the Payment area during checkout. All Credit Card transaction are encrypted and processed online through a Secure Socket Layer (SSL) Connection but your credit card is not charged immediately when you place the order. Your purchase will appear as "MVALENTI LLC" in your statement.
Pay by Mail-in Order: US Customers have the option of paying with Personal/Business Checks and Money Orders from the Unite States Postal Service. For security reasons we do not accept Money Orders from Western Union. Mail-in Orders paid with Personal/Business Checks need 7-10 business days for checks to clear the bank before orders can be shipped.
Taxes:
A 6% sales and use tax will be applied to all customers in the state of Michigan.
Dishonored Checks, Bad Checks, Insufficient Funds Checks, Returned Checks:
As established by the law in the State of Michigan, a $25 Returned Check Fee will be added to any order paid with a Personal/Business check that has been returned by the bank for insufficient funds/no account. The total of the order plus $25 Returned Check Fee shall be paid within 7 business days, excluding weekends and holidays. Failure to comply will result in additional fees, attorney fees and civil/criminal sanctions as established by the law in the State of Michigan.
As established by the law in the State of Michigan, a $35 Returned Check Fee will be added to any order paid with a Personal/Business check that has been returned by the bank for insufficient funds/no account. The total of the order plus $35 Returned Check Fee shall paid within 30 days including weekends and holidays. Failure to comply will result in additional fees, attorney fees and civil/criminal sanctions as established by the law in the State of Michigan.
Gift Cards and e-Gift Certificates:
Manuela Valenti Gift Cards (Biodegradable Gift Cards) and e-Gift Certificates (Electronic Gift Certificates) are issued by Manuela Valenti, LLC. We do not charge any dormancy fees, penalty fees or replacement fees for lost or stolen Gift Cards. Your funds will be available always in your account. Manuela Valenti Gift Cards and e-Gift Certificates cannot be resold, transferred for value, redeemed for cash or applied to any other account, except in states where required by law. Unused Gift Card balances may not be transferred. Resale of Manuela Valenti Gift Cards and e-Gift Certificates is strictly prohibited.
Manuela Valenti Gift Cards and e-Gift Certificates may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities (including without limitation via websites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless prior written approval is requested.
Gift Cards or e-Gift Certificates are only redeemable online at www.manuelavalenti.com towards the purchase of eligible products. Gift Cards and e-Gift Certificates cannot be used to purchase other Gift Cards or e-Gift Certificates or applied to any other containing another Gift Card or e-Gift Certificate. Gift Cards or e-Gift Certificates cannot be used to purchase Valenti VIP Memberships. Manuela Valenti reserves the right to cancel any order if a Gift Card or e-Gift Certificate is used to purchase more Gift Cards or e-Gift Certificates or Valenti VIP Memberships. Purchases are deducted from the Gift Card or e-Gift certificate balance. Any unused balance will be placed in the recipient's Gift Card or e-Gift Certificate account when redeemed. If an order exceeds the amount of the Gift Card or e-Gift Certificate, the balance must be paid with a credit card or other available payment method. Manuela Valenti will have the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Gift Card or e-Gift Certificate is redeemed and/or used to make purchases on manuelavalenti.com.
Lost or stolen Gift Cards cannot be replaced without the original receipt. If your Gift Card is lost or stolen, immediately contact us. Your Gift Card will be cancelled and we will issue a new one with the remaining balance. Manuela Valenti shall have no liability to you for (i) lost or stolen Gift Cards or (ii) use of any Gift Cards or e-Gift Certificates by third parties through your ManuelaValenti.com account. You are solely responsible for keeping the password for your ManuelaValenti.com account safe and for any activity conducted under your account.
When you purchase, receive, or redeem a Manuela Valenti Gift Card or e-Gift Certificate, you agree that the laws of the State of Michigan shall govern these Terms and Conditions, without regard to principles of conflict of laws.
Discount Coupons or Promo Codes:
- Discount Coupons/Promo Codes cannot be used on already discounted products. Manuela Valenti reserves the right to cancel any order where a discount coupon, voucher or promo code has being used on already discounted products or specials due to a human or technical error on manuelavalenti.com.
- Discount Coupons/Promo Codes values, expiration date and restrictions are specified on the Discount Coupons/Promo Codes and can be verified online at http://www.manuelavalenti.com/index.php?main_page=discount_coupon.
- Discount Coupons/Vouchers/Promo Codes are valid only online at manuelavalenti.com and cannot be redeemed through any of our distributors.
- Limit one coupon per household per purchase.

Shipping:
We ship Monday - Friday, excluding federal holidays within the United States. Shipping charges are calculated online directly by the United States Postal Service (USPS) through the checkout process based on the weight of the package and destination of the package. Insurance is included and mandatory with every order. All orders are shipped by USPS within 3 business days of payment being received and effective. Worldwide shipment available. To calculate your shipping costs, simply add any of the items to cart and click the estimate shipping button. Tracking number and Delivery confirmation are provided with every shipment. Shipping charges are non-refundable costs related to your order. Under no circumstances shipping charges will be refunded either by the United States Postal Services or Manuela Valenti.
Orders placed after 3:00 PM (EST) will be processed and shipped by the end of the next business day. Orders received on Saturday and Sunday will be processed on the following business day.
Manuela Valenti is not responsible for undeliverable packages. If USPS has attempted delivery 3 times according to their policies, and they are unable to deliver to the shipping address given, USPS will automatically redirect the package back to our gallery. The customer will be responsible for all shipping charges incurred during this process.
For Canadian and International Customers: Shipping charges are based on the weight of your parcel and will be accurately displayed in the shopping cart (subject to offline verification). Please note that customs, duties, taxes, and other import fees may be imposed on shipments separately from the shipping cost by the country of destination. Manuela Valenti cannot and will not be responsible for these charges. We urge you to check with local authorities regarding customs, duties, taxes and import charges prior to ordering if you are not already familiar with them. Finalizing and submitting your order indicates your acceptance of any duties and taxes your country of destination may impose.

Shipping Insurance:
For the protection of your package and its content, insurance charges are mandatory on every order on all delivery methods and are calculated automatically.
Free Shipping Options:
* Free shipping available for retail customers on orders over $200 within the Continental United States. There is no free shipping option available for wholesale customers. Wholesale customers will pay the regular shipping charges applied which are calculated based on the destination and weight of the package. Please read Shipping terms above.
Damaged or Lost Items During Shipping:
All works are professionally packaged and insurance coverage is provided with every shipment. It is normal for outside boxes and envelopes to show sign of wear, however if the content was damaged, please notify us immediately and report this issue to your carrier. If the outside box looks severely damaged, if possible refuse the shipment and request the driver to note all the details. Damage or loss incurred during shipping is the delivery company's responsibility. Since all our orders ship with insurance from the United States Postal Office, claims must be properly filed with the delivering carrier (USPS) online or at your local post office. Please take pictures of the box and content to record any damage. Keep all the packaging material as you may need to show the condition in which you received your order. Only shipments that are insured can claim the total of the loss, minus shipping or delivery charges, to be reimbursed by the delivery company. Although the addressee must initiate damage claims against the shipper, we will be happy to assist you in all we can. By filing a claim with the United States Postal Office you cannot request a refund from Manuela Valenti.
Returns & Refunds
All sales are final..... but returns are accepted in the case of misrepresentation of the artwork or in the case you didn't like the artwork. We shall guarantee a partial refund from the total amount paid. Shipping, handling and insurance expenses, restocking fee of 15% and any other expenses will be deducted from the total amount at the time of receiving the painting in the same condition it left our studio/gallery. The box shall include all the paper work that accompany the artwork including the Certificate of Authenticity. In the case of paintings damaged during shipping please read the term below.
Custom Duties and Taxes for International Orders:
Any custom duties, taxes and any other charge that the country of destination might apply are the responsibility of the customer. The shipping and handling charges do not include any custom duties that your country might impose. We do not mark packages as gifts or samples. This is an illegal practice in the US.
Certificate of Authenticity:
Every original painting and limited edition print purchased directly from the studio/gallery of artist Manuela Valenti comes with a Certificate of Authenticity hand signed by the artist which includes the information of the artwork along with the Studio Registration Number that matches the painting. This registration number is found printed on the back of the canvas.
Copyright & Trademark Notice
Manuela Valnti works are protected by both The World Intellectual Property Organization (WIPO) which is administered by The Berne Convention for the Protection of Literary and Artistic Works of all international copyright agreements and the Library of Congress of the United States of America. Manuela holds exclusive rights over her artworks, photographs, web design, and text. Any attempt to copy or reproduce or to create derivative works from any the works of art, paintings, photographs or graphics on this website or any of the websites holding works by the artist will be legally prosecuted as stated by law. You may print a hard copy of your order for your records only. You are not authorized to copy or reproduce any of the original paintings you have purchased from this site. Owning an original does not grant to the new owner the rights to reproduce, copy, distribute or display the painting in any public display without the written consent of the artist.
